Abstract

CSR is voluntary based in some countries. The discourse of CSR becomes important to be implemented by corporations including tourism companies. This research study three main research questions concerning the legal basis of CSR, the mandatory of company to implement CSR, and the various form of CSR in practice. The type of this research is Socio Legal Research which social setting Badung, Denpasar, Tabanan and Gianyar. The study shows that in developed countries such as Europe through The European Commision and also America determine the CSR as Voluntary Based, except in the UK, they formolate the CSR as mandatory based under the UK Company Act 2006. In Indonesia CSR is also regulated as mandatory based through the Act No. 40, Year 2007 concerning Limited Liability Company Act and the Act No. 25, Year 2007 concerning Capital Investment Based on the Act No. 40, Year 2007 and the Act No. 25, Year 2007, actually all companies ( personal company, joint venture company , limited liability company, government company (BUMN) and all Foreign Companies have to implement the CSR activitie including tourism industrial companies in Bali. The form of CSR. in tourism industrial copanies in Bali in general refer to the concept of Triple Bottom Line (profit, people and planet). The dominant activities of CSR in Bali related with ”planet” in the form of protecting environmental such as ”Clean and Green”. The other form of CSR are giving scholarship, providing opportunity to work, and renovating the Tample for religion purposes.
